1. Preamble

The following paragraphs provide information on which personal data are gathered when using our website and for what purposes. Personal data are all data relating to your identity, e.g. name, address, e-mail address.

3. Collection and storage of personal data; type and purpose of use

a) On visiting the website:

It is possible to visit our website without being required to enter personal data.

When accessing the website, however, information will automatically be sent to our website’s server via the browser used on your end device. This information will be temporarily stored in a logfile. The following information will be collected in this context without any action on your part and will be stored until the next automatic deletion process:

  • the IP address of the target computer,
  • date and time of the server enquiry,
  • name and URL of the downloaded file,
  • website from which our website was accessed (referrer URL),
  • browser used and, if applicable, your computer’s operating system and the name of your access provider.

We will process the above data for the following purposes:

  • ensuring smooth connection to the website,
  • ensuring that the website is user-friendly,
  • evaluating system security and stability,
  • improving our offering.

The legal basis for data processing is Art. 6(1) sentence 1(f) GDPR. Our legitimate interest can be derived from the data processing purposes set out above. We will never use the collected data in order to draw conclusions relating to you personally.

We also use cookies and analytics services in connection with visits to our website. For more information, see sections 5 and 10 of this Privacy Notice.

b) On registering for our newsletter

You may consent to receive our newsletter, with which we keep you up to date on our latest offers. The goods and services advertised are set out in the declaration of consent.

The newsletter is sent via “MailChimp”, a newsletter mailing platform provided by US-based Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The double opt-in process is deployed when you register for our newsletter. This means that once you have registered, we send you an e-mail to the e-mail address you entered requesting confirmation that you wish to receive our newsletter. This confirmation is necessary in order to ensure that it is impossible to register using third-party e‑mail addresses. Registrations for the newsletter are logged in order to be able to provide the evidence required by law relating to the registration process. This includes the storage of the date and time of registration and confirmation, together with the IP address. Any changes to your data stored with MailChimp will also be logged. If you do not confirm your registration within 24 hours, your information will be blocked and deleted after one month.

The only mandatory information required in order to receive the newsletter is your e‑mail address. The entry of other, separately marked data is voluntary and is used in order to be able to address you personally. Once we have received your confirmation, we will store your e‑mail address for the purpose of sending you the newsletter.

The e‑mail addresses of our newsletter subscribers, together with any other data described in these notes, will be stored on MailChimp’s servers in the USA. MailChimp uses this information to send and analyse the newsletter on our instructions. Moreover, MailChimp itself states that it uses this data to optimise or improve its own services, e.g. to make technical improvements on the mailing process or the presentation of the newsletter or for economic purposes in order to determine the subscribers’ home countries. MailChimp does not, however, use our newsletter subscribers’ data in order to write to them personally or forward such data to third parties.

MailChimp has subscribed to the EU-US Privacy Shield (https://www.privacyshield.gov/EU-US-Framework).

The legal basis for data processing is Art. 6(1) sentence 1(a) GDPR.

You can revoke your consent to receive the newsletter at any time and cancel your subscription. This revocation may be made by clicking the link included in every newsletter e-mail or by sending notice to the contact details provided in the Imprint.

We hereby point out that we will analyse your user behaviour on mailing the newsletter. In order to facilitate this analysis, the e-mails sent contain web beacons or tracking pixels, single-pixel image files that are stored on our website. Our analytics involve linking the data set out in section 3a) and the web beacons to your e-mail address and an individual ID. The data collected in this way enables us to create a user profile in order to tailor the newsletter to your individual interests. In this context, we record which links you click when reading our newsletter and draw conclusions on your personal interests on this basis. We link this data to your actions on our website.

You can object to this tracking at any time by clicking the separate link included in every e-mail or notifying us by other means. The information will be stored for as long as you subscribe to the newsletter. Once you have unsubscribed, we store the data purely statistically and anonymously.

c) On contacting us via e-mail or the contact form

If you contact us by e-mail or via the contact form provided on our website, we will store the data you provide (your e-mail address, together with your name and telephone number, if applicable) in order to process your request or respond to your questions.

If using the contact form, you are required to give a valid e-mail address in order that we know who sent the enquiry and in order to be able to respond to it. All other information is provided on a voluntary basis.

Data relating to you contacting us is processed on the basis of voluntary consent in line with Art. 6(1) sentence 1(a) GDPR.

We will delete any data collected in this context once storage is no longer necessary (if, for instance, your enquiry has been satisfied) or we limit processing if statutory retention periods apply.

d) On submitting an online application

Should you submit a job application online using the application form provided for this purposes on our website, we will process the personal data (application data) you provide, including in particular:

  • first name, surname
  • address
  • telephone number
  • e-mail address
  • application documents (cover letter, CV, references, etc.)

for the purposes of filling vacancies within our company only. Your application data will not be used for any other purposes.

This personal data will be deleted automatically three months after the application process has been completed if your application was unsuccessful for the vacancy in question. The data will only not be deleted after three months if legal requirements prohibit such deletion, the data needs to be stored in connection with establishment, exercise or defence of legal claims or you expressly consented to a longer retention period.

The legal basis for data processing is Art. 6(1) sentence 1(a) and (f) GDPR.

4. Disclosure of data

Your personal data will not be disclosed to third parties for any purposes other than those set out below.

We will only disclose your personal data to third parties if:

  • you granted your express consent pursuant to Art. 6 (1) sentence 1(a) GDPR;
  • disclosure is required pursuant to Art. 6(1) sentence 1(f) GDPR in connection with the establishment, exercise or defence of legal claims and there is no reason to believe that you have an overriding legitimate interest in your data not being disclosed;
  • we are subject to a statutory obligation to such disclosure pursuant to Art. 6(1) sentence 1(c) and
  • this is permitted by law and necessary in connection with implementing contractual relations with you pursuant to Art. 6(1) sentence 1(b) GDPR.

Your application data sent to us in the course of your online application will only be forwarded within our company to the internal offices and departments responsible for the application process in question.

5. Cookies

We use cookies on our website. These are small text files which are automatically created by your browser and stored on your end device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your end device, do not contain any viruses, Trojans or other malware.

Information relating to the specific end device used in each case is stored in the cookie. This does not mean, however, that we directly receive information relating to your identity.

The use of cookies serves on the one hand to make it easier for you to use our services. In this context, we use session cookies to identify whether you have already visited individual pages on our website. These are automatically deleted when you leave our website.

We also use temporary cookies in order to optimise our website’s user-friendliness; these are stored on your end device for a specific period. If you re-visit our website in order to take advantage of our services, the website automatically recognises that you are returning and will remember your data and settings in order to save you from entering these a second time.

The data processed using cookies are required for the stated purposes in order to protect our legitimate interests and those of third parties in line with Art. 6(1) sentence 1(f) GDPR.

Most browsers automatically accept cookies. You can, however, configure your browser such that cookies are not stored on your computer or a notice appears every time a new cookie is created. Full deactivation of cookies may, however, prevent you from being able to use all the functions on our website.

6. Google Analytics

This website uses the Google Analytics service provided by Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (“Google”). The service uses cookies. By saving cookies on your computer, Google can analyse how you use our website. The information on your use of our website that is created by the cookies, together with your IP address, will generally be transmitted to and stored on a Google Inc. server in the USA.

If IP anonymization is activated on this website, your IP address will, however, be anonymised within the Member States of the European Union and in other contracting states to the Agreement on the European Economic Area. The full IP addresses are transferred to a Google server in the USA and anonymised there in exceptional cases only. Google will use this information on the instructions of this website’s operator to analyse your use of the website, to prepare reports on website activities and to provide other services relating to website use for the website operator.

This website uses Google Analytics with the extension “anonymizeIp()”. This means that the IP addresses will be processed in an anonymised form. Thus, the data cannot be directly linked to a particular individual.

For exceptional cases in which personal data are transferred to the USA, Google has subscribed to the EU-US Privacy Shield (https://www.privacyshield.gov/EU-US-Framework).

You can prevent cookies from being stored on your device by making the appropriate settings in your browser. It cannot, however, be guaranteed that you will be able to access all functions on this website without limitation if your browser does not support cookies. You can also prevent the data created by the cookie relating to your use of the website (incl. your IP address) from being collected and processed by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

We will use this tracking in order to ensure our website has a user-friendly structure and can be continually optimised. We also use this tracking in order to automatically collect data on the use of our website and to analyse it in order to optimise our offering for you. These interests are to be seen as legitimate in the context of the above Regulation.

We perform this measure on the basis of Art. 6(1) sentence 1(f) GDPR.

7. Social media plug-ins

We use social media plug-ins for Facebook, Twitter, Instagram and Pinterest on our website in line with Art. 6(1) sentence 1(f) GDPR in order to raise the profile of our company via these channels. The marketing objective behind this measure is to be regarded as a legitimate interest as defined in the GDPR. Each individual provider is responsible for ensuring that operation complies with data protection laws.

These plug-ins are embedded using the “2-click” method. This means that when you visit our website, we will not initially transmit personal data to the plug-in providers. You can identify the plug-in provider by clicking the box above the corresponding initial letter or the logo. We thus make it possible for you to communicate directly with the plug-in provider via this button. The relevant plug-in provider will only receive the information you accessed by visiting our webpage if you click the appropriate field, thus activating it. The data set out in section 3a) of this Privacy Notice will also be transmitted. By activating the plug-ins, therefore, you will send personal data to the respective plug-in provider, which will then be stored on one of the plug-in provider’s servers.

a) Facebook (“Like” button)

We use plug-ins provided by the social network Facebook on our website, which are operated by Facebook Inc., 1601 Willow Road, Menlo Park, CA 94205, USA (“Facebook”). The Facebook plug-ins can be identified by one of the Facebook logos (e.g. white “f” on blue button; “thumbs-up” sign) or are labelled “Facebook social plug-in”. Facebook stores the data relating to you as usage profiles and uses them for advertising, market research and/or needs-based design purposes. You have a right to object to such a user profile being created; in this context, you must contact Facebook directly.

Once you have activated the Facebook button, data will be transmitted irrespective of whether or not you have a Facebook account or are logged into Facebook. If you are logged into Facebook, the data we collected will be directly linked to your existing Facebook account. If you click the activating button and click the “Like” button, for instance, Facebook will also store this information on your user account and will publicly share this information with your contacts. We thus recommend that you regularly log out of Facebook, in particular before you click a button, in order to avoid this information being linked to your Facebook account. You can also generally prevent the Facebook plug-in accessing your data by using add-ons for your browser (e.g. “Facebook blocker”).

Facebook has subscribed to the EU-US Privacy Shield (https://www.privacyshield.gov/EU-US-Framework).

This Facebook plug-in is embedded in line with Art. 6(1) sentence 1(f) GDPR in order to offer you the opportunity to interact with Facebook and other users via this plug-in and to raise the profile of our company.

b) Instagram

We also use social plug-ins provided by Instagram on our website, which are operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA (“Instagram”).

The plug-ins can be identified by the Instagram logo, for instance the Instagram camera.

Once you have activated the Instagram button, data will be transmitted irrespective of whether or not you have an Instagram account or are logged into Instagram. If you are logged into Instagram, Instagram can directly link the fact that you have visited our website to your Instagram account. If you interact via plug-ins, e.g. you click the Instagram button, this information will also be directly transmitted to and stored on an Instagram server. The information will also be published on your Instagram account and your contacts will be able to see it.

If you do not want Instagram to directly assign data collected via our website to your Instagram account, you must log out of your Instagram account before visiting our website.

c) Twitter

Our website also has integrated plug-ins for the short message network run by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94304, USA (“Twitter”). Once you have activated the Twitter button, data will be transmitted irrespective of whether or not you have a Twitter account or are logged into Twitter. If you click a tweet button while you are logged into your Twitter account, you can link the content of our site to your Twitter profile. Twitter is thus able to assign your visit to our site to your user account. We would like to point out that as website provider, we receive no information relating to the content of the data transmitted or how it will be used by Twitter.

If you do not wish your visit to our website to be identified by Twitter, you should log out of your Twitter account before visiting our site.

d) Pinterest

Our website contains plug-ins provided by Pinterest, which is operated by Pinterest Europe Ltd, Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland. The Pinterest plug-ins can be identified by buttons with the “Pin it” logo on a white or red background, for instance.

Once you have activated the Pinterest button, data will be transmitted irrespective of whether or not you have a Pinterest account or are logged into Pinterest. If you are logged into Pinterest, Pinterest can directly link the fact that you visited our website to your Pinterest account. If you interact via the Pinterest plug-ins, this information will also be directly transmitted to and stored on a Pinterest server.

If you do not want Pinterest to directly assign data collected via our website to your Pinterest account, you must log out of your Pinterest account before visiting our website.

8. YouTube

We have embedded videos from YouTube on our website, which belongs to Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; these videos are stored at http://www.YouTube.com and can be played directly from our website.

These videos are all embedded such that no data relating to you as user will be transmitted to YouTube if you do not play the videos. Only if you play the videos will the data set out in section 3a) of this Notice be transmitted. We cannot influence this data transfer.

On visiting one of our webpages which contains corresponding plug-ins, YouTube will receive information that you visited the corresponding webpage. The data set out in section 3a) of this Privacy Notice will also be transmitted. This will take place irrespective of whether YouTube provides a user account to which you are logged in or no such user account exists. If you are logged into Google, your data will be directly linked to your account. If you do not wish the information to be linked to your YouTube profile, you must log out of YouTube before visiting the corresponding page on our website. YouTube stores the data relating to you as usage profiles and uses them for advertising, market research and/or needs-based design purposes. This kind of analysis is conducted in particular in order to provide needs-based advertising (even for users who are not logged in) and in order to inform other users of the social network of your activities on our website. 9. Google Maps

We use services offered by Google Maps on our website. This enables us to display interactive maps directly on our website and offers you convenient use of the map function.

These maps are all embedded such that no data relating to you as user will be transmitted to Google if you do not access the maps. Only if you access the maps will the data set out in section 3a) of this Notice be transmitted. We cannot influence this data transfer.

On visiting one of our webpages which contains corresponding plug-ins, Google will receive information that you visited the corresponding webpage. The data set out in section 3a) of this Privacy Notice will also be transmitted. This will take place irrespective of whether Google provides a user account to which you are logged in or no such user account exists. If you are logged into Google, your data will be directly linked to your account. If you do not wish the information to be linked to your Google profile, you must log out of Google before visiting the corresponding page on our website. 10. Spotify

Functions offered by the music services provider Spotify are embedded on our website. These are provided by Spotify AB, Birger Jarlsgatan 61, 113 56 Stockholm, Sweden. The Spotify plug-ins can be identified by the green logo on our website. An overview of the Spotify plug-ins is available at https://developer.spotify.com.

If you access pages on our website containing Spotify plug-ins, a direct link is created between your browser and Spotify’s servers. Spotify will thus receive the information that you accessed the corresponding page on our website from your IP address.

If you have a Spotify account, these data could be linked to your account. If you do not wish these data to be linked to your Spotify account, you must log out of Spotify before visiting our website. Interactions will also be forwarded to Spotify.

11. Facebook Pixel

With your consent, we use Facebook Pixel, provided by Facebook Inc. (“Facebook”) to track user actions. This helps us to track user actions once they have seen or clicked a Facebook ad. This enables us to record the effectiveness of the Facebook ads for statistical and market-research purposes. The data recorded in this way are anonymous for us, i.e. we cannot identify the personal data of individual users. These data are, however, stored and processed by Facebook, and we will inform you of this as far as we are aware of it. Facebook can link these data to your Facebook account and use them for its own advertising purposes in line with its privacy policy; https://www.facebook.com/about/privacy/. You can enable Facebook and its partners to display ads on and outside Facebook pages. A cookie could also be stored on your computer for these purposes.

This consent may only be given by users who are older than 13 years of age. If you are younger, please consult your parent or guardian.

12. Amazon partner program (Amazon Affiliate)

Edel participates in the partner program offered by Amazon Europe S.à.r.l. and is a partner of the advertising program which was created to provide a medium for websites which enables advertising costs to be recouped via the placement of ads and links to amazon.de. In participating in the program, we endeavour to display ads which could be of interest to you and which make our website more interesting to our users.

Statistical information relating to you is collected in return for providing the ads, which is then processed by our advertising partners. When you visit our website, Amazon will receive the information that you accessed on visiting our webpage. In this context, Amazon uses web beacons to identify your requirements and may create a cookie on your computer. The data set out in section 3a) of this Privacy Notice will also be transmitted. We have no influence on the data collected and we are not aware of the full scope of the data collected or the retention period. If you are logged into Amazon, your data may be directly linked to your Amazon account. If you do not wish this data to be linked to your Amazon profile, you must log out of Amazon. It is possible that your data may be forwarded to contracting partners of Amazon and public authorities. The data are transmitted to the USA and are analysed there.

The legal basis for the processing of your data is Art. 6(1) sentence 1(f) GDPR.

You can prevent cookies being installed by the Amazon partner program using one of several methods: a) by making a corresponding setting in your browser software, preventing third‑party cookies in particular means that you will not receive advertising from third parties; b) by deactivating interest-based advertising from Amazon via the following link: https://www.amazon.com/adprefs; c) by deactivating interest-based advertising from providers who participate in the self-regulation campaign “AboutAds” by making corresponding settings via the link http://www.aboutads.info/choices, which will delete the relevant cookies. 13. Linkfire

We use the music sales analysis tool “Linkfire” provided by Linkfire ApS, Artillerivej 86, 3., 2300 Kopenhagen S, Denmark, on our website.

This helps us to offer you a clear summary of various online providers of a particular product in a single link. We can also track users’ actions once they have clicked a Linkfire link. The data recorded in this way are anonymous for us, i.e. we cannot identify the personal data of individual users. These data are, however, stored on Linkfire servers in Denmark. We have no influence on the scope and further use of the data by Linkfire.

14. Your rights

a) Information, rectification, erasure, restriction of processing, data transferability, revocation, complaints

You have the right:

  • to receive, pursuant to Art. 15 GDPR, information on your personal data processed by us. You can, in particular, receive information on the purposes of processing, the categories of personal data, the categories of recipient to whom the personal data have been or will be disclosed, the envisaged period for which the personal data will be stored, the existence of the right to request rectification, erasure, restriction of processing of personal data or the right to lodge a complaint, where the personal data are not collected from us, any available information as to their source, the existence of automated decision-making, including profiling, and meaningful information about the corresponding details, if applicable;
  • to obtain, pursuant to Art. 16 GDPR, without undue delay the rectification of inaccurate or incomplete personal data stored by us;
  • to obtain, pursuant to Art. 17 GDPR, the erasure of your personal data stored by us, provided processing is not required in order to exercise the right of freedom of expression and information, for compliance with a legal obligation, for the performance of a task carried out in the public interest or for the establishment, exercise or defence of legal claims;
  • to obtain, pursuant to Art. 21 GDPR, restriction of processing, where you contest the accuracy of the personal data, the processing is unlawful, you oppose the erasure of the personal data and we no longer need the personal data, but they are required by you for the establishment, exercise or defence of legal claims pursuant to Art. 18 GDPR or you have exercised your right to object;
  • to receive, pursuant to Art. 20 GDPR, the personal data concerning you, which you provided, in a structured, commonly used and machine-readable format and to demand transmission of those data to another controller;
  • to withdraw your consent at any time pursuant to Art. 7(3) GDPR by making a corresponding statement to us. This means that we are not permitted to continue to process the data to which this consent applied in future; and
  • to lodge a complaint with a supervisory authority, pursuant to Art. 77 GDPR. You can generally lodge such complaint with the supervisory authority in the place of your habitual residence, place of work or our branch.

b) Right to object

If your personal data are processed on the basis of justified interests pursuant to Art. 6(1) sentence 1(f) GDPR, you have the right to object to the processing of your personal data, pursuant to Art. 21 GDPR, on grounds relating to your particular situation or the objection relates to direct marketing.  In the latter case, you have a general right to object which will be implemented by us without you having to specify grounds.

15. Data security

We use the popular SSL (secure sockets layer) technology in conjunction with the highest level of encryption supported by your browser when you access our website. This is generally 256‑bit encryption. If your browser does not support 256-bit encryption, we will use 128-bit v2 technology instead. You can identify whether or not an individual page on our website is transmitted in encrypted form by the closed key/padlock symbol in the lower status bar on your browser.

Online applications are transferred in encrypted form according to the latest technological standards.

We also use suitable technical and organisational security measures in order to protect your data against accidental or deliberate manipulation, partial or total loss, destruction or unauthorised access by third parties. Our security measures are continually improved in line with technological developments.
